Why society is registered?

The Society Registration Act, 1860 has a mere purpose of giving a boost to literature, fine arts, science or distribution of awareness for bountiful purposes.

A Society has many different purposes to operate and some of many are as follow:

  1. Promotion of fine arts
  2. Diffusion of political education
  3. Grant of charitable assistance
  4. Promotion of science and literature
  5. Creation of military orphan funds
  6. Maintenance or foundation of galleries or public museum
  7. Maintenance or foundation of reading rooms or libraries
  8. Promotion or diffusion or instruction of useful knowledge
  9. Social Welfare
  10. Social Development
  11. Or other charity, welfare or development objective.

Benefits of Society registration

  • After registration a Society gains a status of a legal entity.
  • Facilities like Sell, buy, rent as well as Right to lease can be availed by a Society.
  • A membership of a Society may change but it will continue to be a separate entity.
  • Income Tax exemption can be availed by a Society if a Society is incorporated.
  • In case of unlawful activities, the members are held to pay the debts as well as obligations.
  • In case of profit, if debts and obligations are incurred by members for the purpose of obtaining money, the members are liable to pay else members can’t be held liable.
  • Incorporated Society is required to meet minimum requirements which are set by Incorporated Society Act 1908 which gives an assurance to members of the Society.
  • The bank accounts can be opened by Society.
  • Society gains recognition in front of Forums as well as Authorities.

Categories of NGO Registration

  1. Societies registered under section 20 of the Societies Registration Act 1860.
  2. Trusts formed under Indian Trusts Act 1882
  3. Section 8 Company as per Companies Act,2013

Registration Requirement for Society

Any individual who fulfills following eligibility criteria can register under The Society Registration Act, 1860.

    1. Minimum 7 members required (Minimum 8 at National Level).
    2. A subscription to memorandum of association.
    3. Any Foreigner with verified documents is eligible.
    4. Any partnership firm and limited company is eligible.
    5. A Minor is NOT eligible.
    6. Other than this any individual who is competent to enter in any kind of a contract or legal agreements can be eligible.

Procedure to obtain society registration

  1. A unique name is selected by the applicant by conducting a comprehensive research and ensure that the name is not similar to any other incorporated society/ Body corporate
  2. Memorandum of Association is drafted and ach establishing member of the Society must sign the Memorandum with Rules and Regulations of the Society. It should be witnessed by Notary Public, Chartered Accountant, Oath Commissioner, Gazetted Officer, First Class Magistrate or Advocate with their official stamp and complete address.
  3. All the other necessary documents are prepared
  4. File all the documents with the concerned registrar of your state and specified fees is paid.
  5. It usually takes around one month to get the society registered

A PAN card of all the members associated with the society.

A Resident Proof is mandatory.
